Licence Agreement

The datasets stated in the below Schedule are covered by Licence Agreements and have been supplied expressly for the purposes of inclusion in a pilot iPhone application focussing on health and wellbeing themes for Albert Park.
Use of these datasets is subject to the conditions stated below and by downloading the data, you are agreeing with the terms of use.
Data Exchange Agreement:
1. All maps produced using this data contain the following phrase:
"Digital data used with the permission of Parks Victoria"
2. Yourself, your representatives or agents shall not copy, alter or otherwise make use of the data supplied, or of products derived from the data, except for the purpose stated.
3. Department of Sustainability and Environment and Parks Victoria does not warrant that this data is complete or free of errors.
4. Department of Sustainability and Environment and Parks Victoria will not be liable to loss, costs, damage or injury, howsoever arising which may be suffered by the other party in connection with this agreement or any use of the data.
5. It is expressly prohibited to rent, lease, sublicense, lend, sell, assign, transfer or in any other way commercially exploit the data other than for the purpose stated in this agreement.
6. You agree to indemnify Department of Sustainability and Environment and Parks Victoria and keep Department of Sustainability and Environment and Parks Victoria indemnified in respect of all liability for loss, costs, damage or injury incurred to a third person in connection with any use of the data arising out of this agreement.
7. Updates to the datasets stated below are not covered by this agreement.
These datasets are being provided for no fee as an initial stimulus to application development. Updates to datasets provided and additional requests for data will be subject to a separate agreement and possible fees.
